Normally, the date of

confirmation does not affect an officer's seniority

unless confirmation is delayed through an officer's

own fault in circumstances in which a penalty is

regarded appropriate.

It is clear that arbitrary decision

must be taken in regard to the seniority of these

three officers. Mr.Wilby is 31. In December 1935

when he was transferred to Hong Kong he had had just

over seven years' Colonial Service and he started in the

Hong Kong salary scale at £710. Mr.Walton is nearly

28.

In December 1935 he had just four years' Colonial

Service.

He started in Hong Kong at £500 the

minimum of the scale.

Mr.Dyer is nearly 32. He also

had in December 1935 just over four years' Colonial

Service, and started at £500 in Hong Kong. He had been

retrenched from the Gold Coast in October 1932 and was

appointed to Hong Kong in September 1934.
